Penalties for DUI

First Conviction for DUI within a 10 year period

  • Minimum sentence is 12 months.
  • 10 days to be served in custody; however, all but 24 hours of the time in custody can be suspended or probated by the Judge. The balance of the 12 months sentence will be served on probation.
  • A minimum fine of $300 to a maximum fine of $1000, plus applicable surcharges.
  • Attend and complete a Risk Reduction Course, commonly referred to as DUI School.
  • Complete a minimum of 40 hours of community service.
  • Obtain an evaluation for substance abuse issues.
  • Your driver's license, or privilege to drive in Georgia, will be suspended for one year. In certain circumstances, you may obtain a limited driver's permit and if you complete the Risk Reduction Course within 120 days you may have your full license reinstated after 120 days.
Second Conviction for DUI within a 10 year period
  • Minimum sentence is 12 months.
  • 90 days to be served in custody; however, all but 72 hours of the time in custody can be suspended or probated by the Judge. The balance of the 12 month sentence will be served on probation.
  • A minimum fine of $600 to a maximum fine of $1000, plus applicable surcharges.
  • Attend and complete a Risk Reduction Course, commonly referred to as DUI School.
  • Complete a minimum of 240 hours (30 days) of community service.
  • Obtain an evaluation for substance abuse issues.
  • Your driver's license, or privilege to drive in Georgia, will be suspended for 18 months*. Installation of an Ignition Interlock device will allow you to reinstate your driver's license after 12 months. There is no limited permit available.
  • Installation of an Ignition Interlock Device on your vehicle.
  • Publication of your picture in the newspaper for the county you were arrested in.
  • Surrender of the license plates for any vehicle you own.
Third Conviction for DUI within a 10 year period - High and Aggravated Misdemeanor
  • Minimum sentence is 12 months.
  • 120 days to be served in custody; however, all but 15 days of the time in custody can be suspended or probated by the Judge. The balance of the 12 month sentence will be served on probation.
  • A minimum fine of $1000 to a maximum fine of $5000 plus surcharges.
  • Complete a minimum of 240 hours (30 days) of community service.
  • Obtain an evaluation for substance abuse issues.
  • Your driver's license, or privilege to drive in Georgia, will be revoked for a period of 5 years**. A probationary license is available after 2 years; however, no limited permit is available.
  • Installation of an Ignition Interlock Device on your vehicle.
  • Publication of your picture in the newspaper for the county you were arrested in.
  • Surrender of the license plates for any vehicle you own.

* In cases where the second DUI was less than five years from the first DUI arrest from which a conviction was obtained.
** In cases where the third DUI was less than five years from the first and second DUI arrests from which convictions were obtained.
